MIAMI HOUSE CLEANING

TERMS OF SERVICE, LIABILITY WAIVER & RELEASE

By booking, scheduling, or receiving cleaning services from Miami House Cleaning, the client (“Client”) agrees to the following Terms of Service in full:


1. ASSUMPTION OF RISK

Client understands and agrees that cleaning services involve inherent risks, including but not limited to accidental damage, breakage, or loss of personal property. Client voluntarily assumes all such risks associated with the services provided.


2. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Miami House Cleaning, its owners, employees, contractors, agents, and affiliates shall not be held liable for any damages, loss, theft, or disappearance of property, whether real or personal, including but not limited to:

  • Jewelry, cash, collectibles, artwork, antiques, electronics, or other valuables

  • Pre-existing damage, wear and tear, or structural issues

  • Damage resulting from normal cleaning activities

Client is responsible for securing or removing all valuables prior to service.


3. WAIVER & RELEASE OF CLAIMS

Client hereby waives, releases, and forever discharges Miami House Cleaning from any and all claims, demands, actions, causes of action, damages, or liabilities of any kind, whether known or unknown, arising out of or related to the cleaning services provided.

This includes, but is not limited to, claims based on:

  • Negligence

  • Property damage

  • Alleged theft or loss

  • Personal injury


4. NO LEGAL ACTION OR REPORTS

To the fullest extent permitted by law, Client agrees not to initiate or pursue any lawsuits, legal claims, police reports, insurance claims, or third-party complaints against Miami House Cleaning related to alleged damages, loss, or theft arising from the services.


5. INDEMNIFICATION

Client agrees to indemnify and hold harmless Miami House Cleaning from any claims, damages, costs, attorney fees, or expenses arising from Client’s failure to comply with these Terms or from conditions at the Client’s property.


6. INSURANCE & PERSONAL PROPERTY

Client understands that Miami House Cleaning does not provide insurance coverage for Client’s personal belongings. Client is encouraged to rely on their own homeowner’s or renter’s insurance if desired.


7. PHOTOS & DOCUMENTATION

Client agrees that Miami House Cleaning may take before-and-after photos or videos of the property for quality assurance, documentation, or dispute resolution purposes.


8. ACCEPTANCE OF TERMS

By booking services, submitting payment information, signing electronically, or allowing cleaners access to the property, Client confirms they have read, understood, and agreed to these Terms of Service in full.


Miami House Cleaning

ADDITIONAL TERMS OF SERVICE

By booking, scheduling, or receiving services from Miami House Cleaning, the client agrees to the following additional Terms of Service, which supplement all previously provided agreements.


1. RIGHT TO CANCEL SERVICES

Miami House Cleaning reserves the right to cancel, reschedule, or decline any appointment at any time, with or without notice, and for any reason, including but not limited to staffing availability, safety concerns, access issues, or operational needs.


2. INSPECTION & DAMAGE CLAIM RIGHTS

Miami House Cleaning reserves the right to inspect any claimed damage before accepting responsibility, approving repairs, or issuing compensation.

  • Claims that do not permit inspection will not be approved.

  • Repairs or replacements completed before inspection are not eligible for reimbursement.


3. DAMAGE LIMITATION

For any approved claim, Miami House Cleaning reserves the right, at its sole discretion, to:

  • Repair the item

  • Replace the item

  • Provide a service credit

  • Issue compensation

Maximum liability is limited to the lesser of:

  • The original cost of the cleaning service, or

  • One hundred dollars ($100)


4. PRE-EXISTING DAMAGE & NORMAL WEAR

Miami House Cleaning is not responsible for:

  • Pre-existing damage or defects

  • Loose fixtures or hardware

  • Worn, aged, or deteriorated surfaces

  • Broken items or malfunctioning appliances

Normal wear and deterioration—including paint wear, grout issues, loose hardware, peeling finishes, or aged materials—are considered normal conditions and are not the responsibility of Miami House Cleaning.


5. SENSITIVE MATERIALS & SPECIAL SURFACES

Clients must notify Miami House Cleaning in writing before the appointment of any specialty materials, delicate surfaces, or items requiring special handling.
Miami House Cleaning is not responsible for damage to sensitive materials or finishes cleaned with standard products unless written instructions are provided in advance.


6. SECURING VALUABLES

Clients agree to secure jewelry, cash, medications, personal valuables, and sentimental items before the appointment.
Miami House Cleaning is not responsible for misplaced, lost, or unsecured items accessible during service.


7. CLAIMS & PHOTO EVIDENCE

All concerns must be submitted through the official Miami House Cleaning Claim Form within twenty-four (24) hours of the appointment and must include clear photos.

  • Claims submitted verbally or by text without the completed form will not be reviewed

  • Claims submitted after 24 hours are not eligible


8. WALKTHROUGH ACKNOWLEDGEMENT

If a walkthrough is completed and the client approves the condition of the property, that approval will be considered during any claims review.


9. CLAIM REVIEW TIMELINE

All claims require three (3) to five (5) business days for review. Outcomes may include:

  • Re-clean

  • Service credit

  • Partial refund

  • Claim denial due to insufficient evidence or pre-existing damage


10. CRIMINAL OR THEFT CLAIMS

If theft or criminal activity is suspected, the client must:

  • Notify Miami House Cleaning within 24 hours, and

  • File a police report

Claims without a police report cannot be processed. Miami House Cleaning will cooperate with investigations.


11. RIGHT TO DECLINE UNSAFE TASKS

Miami House Cleaning may decline any task that poses risk of damage or safety concern.


12. OPEN SHELVING & FRAGILE ITEMS

Clients must clear open shelving containing fragile or valuable items before service. Miami House Cleaning is not responsible for items left unsecured.


13. ALLERGIES & SENSITIVITIES

Standard cleaning products are used. Clients must notify Miami House Cleaning in writing of allergies or sensitivities in advance. Miami House Cleaning is not responsible for reactions to standard products.


14. UNSAFE OR UNSANITARY CONDITIONS

Miami House Cleaning may refuse or discontinue service due to unsafe, hazardous, or extremely unsanitary conditions. Clients remain responsible for time or travel costs already incurred.


15. MOLD & HAZARDOUS MATERIALS

Miami House Cleaning does not remediate mold, biohazards, chemicals, or hazardous substances and assumes no liability related to them.


16. HIDDEN DAMAGE

Miami House Cleaning is not responsible for hidden damage, leaks, structural issues, or deterioration revealed during cleaning.


17. BREAKAGE & FRAGILE ITEMS

Clients must remove fragile or valuable items from accessible areas. Miami House Cleaning is not responsible for breakage of unsecured items.


18. HEAVY ITEMS & APPLIANCES

Cleaners are not required to move heavy furniture or appliances. Items must be moved by the client prior to service.


19. ACCESS & LOCKOUTS

Clients must provide access during the scheduled window. If access is not granted within 15 minutes, the appointment may be canceled and fees may apply.


20. CLIENT-PROVIDED PRODUCTS

If client-provided products are used, the client assumes all responsibility for resulting damage or reactions.


21. PETS

Clients must secure pets. Miami House Cleaning is not responsible for escaped pets or pet-related issues.


22. NO GUARANTEE OF STAIN REMOVAL

Certain stains or buildup may not be removable. Results are not guaranteed.


23. PRICING ADJUSTMENTS

Pricing is based on estimated condition. Additional labor may result in pricing adjustments.


24. RECURRING SERVICE TERMS

Recurring rates require consistent service frequency. Skipped or neglected cleanings may result in repricing.


25. CANCELLATIONS

Cancellations with less than 24 hours’ notice may incur fees.


26. AUTHORITY TO PHOTOGRAPH

Clients grant permission for before-and-after photos for documentation and quality control.


27. ACCESS & ENTRY CONSENT

By booking, the client authorizes Miami House Cleaning and its cleaners to enter, exit, and reenter the property during the scheduled appointment window for service-related purposes.


28. DISPUTE RESOLUTION

All disputes must first be submitted in writing for good-faith resolution. If unresolved, parties agree to mediation, then binding arbitration in Miami-Dade County, Florida, waiving the right to jury trial.


29. NON-SOLICITATION OF CLEANERS

Clients agree not to hire or solicit Miami House Cleaning cleaners directly for two (2) years. A $500 referral fee may apply.

30. FORCE MAJEURE / EVENTS BEYOND CONTROL

Miami House Cleaning shall not be held liable for delays, cancellations, rescheduling, or inability to perform services due to circumstances beyond reasonable control, including but not limited to severe weather, flooding, traffic accidents, illness, emergencies, power outages, building access issues, acts of God, or government restrictions.


31. STANDARD OF CLEANING & REASONABLE EXPECTATIONS

Cleaning services are provided to a professional and reasonable standard, not a standard of perfection. Results are subjective, and Miami House Cleaning does not guarantee outcomes based on personal preferences or expectations beyond standard professional cleaning practices.


32. ONE OPPORTUNITY TO ADDRESS APPROVED ISSUES

If a concern is approved through the claims review process, Miami House Cleaning must be given one reasonable opportunity to re-clean or otherwise address the issue before any credit, refund, or compensation is considered.


33. CLIENT MISREPRESENTATION OF PROPERTY CONDITION OR SCOPE

If the size, condition, level of dirt, access, or scope of work is materially different from what the client represented at booking, Miami House Cleaning reserves the right to adjust pricing, modify the scope of services, or decline or discontinue service.


34. CLUTTER, EXCESS ITEMS & INACCESSIBLE AREAS

Miami House Cleaning is not responsible for cleaning areas that are inaccessible due to clutter, excessive belongings, storage items, stacked objects, or unsafe conditions. Cleaning around heavy clutter does not guarantee full results.


35. ODOR DISCLAIMER

Miami House Cleaning does not guarantee the removal of odors, including but not limited to pet odors, smoke odors, food odors, moisture-related odors, or construction-related odors.


36. WEATHER, HUMIDITY & ENVIRONMENTAL CONDITIONS

Environmental factors such as humidity, airflow, open windows, HVAC operation, or weather conditions may affect drying time, dust resettlement, or streaking. Miami House Cleaning is not responsible for results impacted by these conditions.


37. CLIENT-DIRECTED OR HIGH-RISK TASKS

If Miami House Cleaning performs a task at the client’s specific request that carries an increased risk of damage, the client assumes full responsibility for any resulting damage or outcome.


38. TRASH REMOVAL & JUNK DISCLAIMER

Miami House Cleaning is a cleaning service and not a junk removal company.

  • Removal of one (1) standard household trash bag is included per appointment

  • Removal of additional trash bags, oversized bags, construction debris, or bulk waste may result in additional charges

  • Miami House Cleaning does not remove heavy items, furniture, appliances, mattresses, large boxes, or bulk debris

Clients requiring junk or bulk removal must arrange a separate service.


39. PAYMENT AUTHORIZATION & CHARGEBACKS

By providing payment information, the client authorizes Miami House Cleaning to charge for services rendered. Chargebacks initiated without good-faith participation in the dispute or claims process may result in documentation being submitted to the payment processor and suspension of future services.


40. UNPAID BALANCES & COLLECTIONS

Any unpaid balances may be subject to administrative fees, collection efforts, and refusal of future services until payment is resolved.


41. DEFAMATION & GOOD-FAITH PARTICIPATION DURING DISPUTES

Clients agree to act in good faith during any active claim or dispute and not to publish false, misleading, or defamatory statements regarding Miami House Cleaning while the review process is ongoing.


42. SEVERABILITY

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


43. MODIFICATION OF TERMS

Miami House Cleaning reserves the right to update or modify these Terms of Service at any time. The version in effect at the time of booking shall govern the service.

44. NO WARRANTY OR IMPLIED GUARANTEES

Miami House Cleaning makes no warranties, express or implied, regarding services provided, including but not limited to warranties of merchantability, fitness for a particular purpose, or guaranteed outcomes. All services are provided “as is” and “as available.”


45. LIMITATION OF CONSEQUENTIAL & INDIRECT DAMAGES

To the fullest extent permitted by law, Miami House Cleaning shall not be liable for indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of use, loss of enjoyment, loss of business, loss of income, or emotional distress.


46. CLIENT NEGLIGENCE OR INTERFERENCE

Miami House Cleaning is not responsible for damages, delays, or unsatisfactory results caused by client negligence, interference, inaccurate instructions, failure to disclose conditions, or actions taken by the client or third parties before, during, or after the service.


47. TIME-BASED SERVICE ACKNOWLEDGEMENT

Client acknowledges that cleaning services are time-based services, not outcome-based guarantees. Payment is for labor time and professional effort, not for guaranteed removal of all dirt, buildup, residue, stains, or debris.


48. SERVICE INTERRUPTION OR EARLY TERMINATION

Miami House Cleaning reserves the right to stop or terminate services if unsafe conditions arise, access is revoked, hostile behavior occurs, or circumstances change during service. No refunds are owed for time already worked.


49. HARASSMENT, ABUSE, OR UNSAFE BEHAVIOR

Miami House Cleaning reserves the right to immediately discontinue service if cleaners experience harassment, threats, discrimination, unsafe behavior, or inappropriate conduct. Such termination does not entitle the client to a refund.


50. CLIENT RESPONSIBILITY FOR UTILITIES

Client is responsible for ensuring access to water, electricity, lighting, and climate control as reasonably required to perform services. Miami House Cleaning is not responsible for incomplete service due to unavailable utilities.


51. PARKING, TOWING & ACCESS FEES

Client is responsible for providing legal parking and access. Miami House Cleaning is not responsible for parking tickets, towing, or access fees caused by unavailable or restricted parking.


52. SECURITY SYSTEMS & SURVEILLANCE DISCLOSURE

Client must notify Miami House Cleaning of any active alarm systems, cameras, recording devices, or security features. Miami House Cleaning is not responsible for false alarms, monitoring fees, or access issues related to security systems.


53. BUILDING RULES & HOA COMPLIANCE

Client is responsible for informing Miami House Cleaning of building rules, HOA requirements, access procedures, or restrictions. Miami House Cleaning is not liable for service delays or issues caused by undisclosed rules.


54. ABANDONED SERVICE OR EARLY CLIENT DEPARTURE

If the client leaves the property, revokes access, or requests early departure during service, the appointment is considered complete for billing purposes.


55. NO RESPONSIBILITY FOR POST-SERVICE CONDITIONS

Miami House Cleaning is not responsible for conditions occurring after service completion, including dust resettling, re-soiling, spills, traffic, weather effects, or actions of occupants, pets, or visitors.


56. COMMUNICATION & OFFICIAL CONTACT METHODS

Official communication regarding claims, billing, or disputes must occur through approved Miami House Cleaning channels. Messages sent through unofficial platforms may not be received or processed.


57. ELECTRONIC RECORDS & DIGITAL CONSENT

Client agrees that electronic records, timestamps, photos, GPS logs, and digital communications may be used as evidence for service verification, billing, dispute resolution, and chargeback defense.


58. NO THIRD-PARTY BENEFICIARIES

These Terms of Service are solely for the benefit of Miami House Cleaning and the Client and do not create rights for any third party.


59. GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law principles.


60. ENTIRE AGREEMENT

These Terms of Service constitute the entire agreement between the Client and Miami House Cleaning and supersede all prior discussions, representations, estimates, or agreements, whether written or oral.


61. CLIENT ACKNOWLEDGEMENT & ACCEPTANCE

By booking services, submitting payment, signing electronically, or allowing access to the property, the Client acknowledges that they have read, understood, and agreed to all Terms of Service, including all limitations, exclusions, waivers, and dispute resolution provisions.



POST-CONSTRUCTION & RENOVATION CLEANING TERMS

1. SCOPE OF POST-CONSTRUCTION CLEANING

Post-construction and renovation cleaning focuses on general dust removal, debris cleanup, and surface cleaning following construction or remodeling work. This service is not a restoration, remediation, or detailing service.


2. NO GUARANTEE OF MATERIAL REMOVAL

Miami House Cleaning does not guarantee the complete removal of:

  • Paint splatter or overspray

  • Caulk, adhesives, or sealants

  • Concrete, grout haze, mortar, or drywall compound

  • Construction markings, pencil lines, tape residue, or stickers

  • Epoxy, thinset, silicone, or other hardened construction materials

Some construction materials permanently bond to surfaces and cannot be safely removed without risk of damage.

3. SURFACE DAMAGE RISK

Attempting to remove construction materials may damage finishes, coatings, flooring, fixtures, glass, cabinetry, or appliances.
Miami House Cleaning will not attempt removal methods that could reasonably cause damage and is not responsible for remaining stains, markings, or bonded materials.


4. SPECIALTY REMOVAL EXCLUDED

The following are not included in post-construction cleaning:

  • Razor scraping or aggressive abrasion

  • Chemical stripping or solvent use

  • Polishing, refinishing, or resurfacing

  • Removal requiring professional restoration services

Clients requiring these services must hire specialized contractors.


5. PRE-EXISTING & CONSTRUCTION DAMAGE

Miami House Cleaning is not responsible for:

  • Scratches, chips, etching, or cracks caused by construction

  • Damaged finishes, seals, or coatings

  • Improperly installed materials or fixtures

  • Manufacturer defects or builder workmanship issues


6. CLIENT ACKNOWLEDGEMENT

By booking post-construction or renovation cleaning, the client acknowledges and agrees that:

  • Some construction residue may remain after cleaning

  • Results vary based on surface type, age, and materials used

  • Payment is for time and labor, not guaranteed outcomes


7. DAMAGE LIMITATION

Any claim related to post-construction cleaning remains subject to Miami House Cleaning’s general damage limitation, with maximum liability limited to the lesser of the service cost or $100, as outlined in these Terms of Service.

 


Additional Terms of Service 

1. Terms

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law. Please note: we reserve the right to charge a 100% no-show fee if you’re unreachable or our cleaners can’t access the property. Cancellations made within 24 hours of your appointment may incur a 50% fee.

2. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on BookingKoala’s web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
